These Terms of Service (“Terms”) govern your access to and use of websites, forms, booking tools, and communications operated by Shark Shine Detail LLC (“Shark Shine,” “we,” “us,” or “our”), and your participation in our SMS/text messaging program.

By accessing our websites, submitting a form, booking a service, or opting into SMS, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our websites or messaging program.

We provide mobile vehicle detailing and luxury estate / property care services (including soft washing, window cleaning, outdoor living area care, and related exterior maintenance), and may provide commercial property maintenance and recurring maintenance plans, primarily in Chandler, Scottsdale, Paradise Valley, and surrounding Phoenix metro areas.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use our websites for booking or contracting services. If you use our sites on behalf of a company, HOA, or other entity, you represent that you have authority to bind that entity.

3. Website use

You may use our websites to learn about services, request estimates, book appointments, and contact us. You agree not to:

• Use the sites for unlawful purposes
• Submit false, misleading, or fraudulent information
• Attempt unauthorized access to systems, accounts, or data
• Interfere with site security or operations
• Scrape, harvest, or misuse contact forms or content except as allowed by law and these Terms
• Impersonate any person or entity

We may suspend or restrict access for conduct we reasonably believe violates these Terms or creates risk.

Website content (text, branding, photos, layout) is owned by Shark Shine or its licensors and may not be copied for commercial use without permission, except for ordinary personal viewing and sharing links.

4. Estimates, bookings, and services

4.1 Estimates

Estimates may be based on information, photos, and descriptions you provide. Final pricing and scope may change after on-site inspection due to condition, access, size, add-ons, or safety factors. An estimate is not a guaranteed final price unless we confirm otherwise in writing.

4.2 Bookings and access

You are responsible for providing accurate service address, contact information, and any access instructions you choose to share (gate codes, garage access, HOA rules). If you authorize work while you are not present, you represent that you have authority to grant that access and that the property/vehicles may be serviced as described.

4.3 Service standards

We perform services with professional care consistent with the agreed scope. Results can vary based on surface condition, prior coatings, weather, water quality, and other factors outside our control. We will communicate material limitations when known.

4.4 Cancellations and rescheduling

Cancellation and reschedule timing may be confirmed at booking or in writing (including SMS/email). Late cancellations or no-shows may result in fees if disclosed at booking.

4.5 Payment

Payment methods and timing (deposit, due on completion, invoice terms) will be stated at booking or on the invoice. You agree to pay amounts due for services rendered. Failed payments may result in collection activity as allowed by law.

4.6 Vehicles and property

You represent that you own or are authorized to request service on the vehicles and property identified. Tell us about known damage, specialty finishes, fragile items, or restricted areas before work begins. We are not responsible for pre-existing damage, latent defects, or manufacturer defects.

5. SMS / text messaging program (required for A2P compliance)

Program description:
Shark Shine sends text messages related to mobile detailing and luxury estate / property care services. Depending on the consent you provide, transactional messages may include appointment confirmations, service updates, and reminders; marketing messages may include service and product specials and other promotional SMS, only if separately opted in.

5.0 On-site SMS consent language (what clients agree to)

The following consent language is presented on Shark Shine websites and forms. Checkboxes are optional, not pre-selected, and not required to submit a form. This is what clients consent to when they opt in.

Clients may select one, both, or neither. Transactional consent does not include marketing consent. Marketing consent does not replace transactional consent.

5.1 Required SMS terms

1. Program description. Consistent with our on-site consent language: transactional texts may include appointment confirmations, service updates, and reminders; marketing texts (separate opt-in) may include service and product specials and other promotional messages from Shark Shine Detail LLC.
2. Opt-out. You can cancel the SMS service at any time. Just text STOP to the Shark Shine messaging number. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
3. Help / support. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at (480) 743-3295 or chris@sharkshinedetail.com.
4. Carrier liability. Carriers are not liable for delayed or undelivered messages.
5. Frequency and rates. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages with message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

5.2 Consent rules

Consent to receive SMS is optional and is not required to submit website forms solely to make an inquiry. Where both marketing and non-marketing messages are offered, consent is collected separately. We do not buy consent. We keep records of opt-in where required for compliance.

6. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using our websites or SMS program, you also acknowledge that Policy.

7. Disclaimers

EXCEPT AS EXPRESSLY STATED IN WRITING FOR A SPECIFIC JOB, SERVICES AND WEBSITES ARE PROVIDED ON AN “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SHARK SHINE DETAIL LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE WEBSITES, MESSAGING PROGRAM, OR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE WEBSITES OR MESSAGING PROGRAM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). OUR TOTAL LIABILITY FOR A SPECIFIC PAID SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THAT SERVICE GIVING RISE TO THE CLAIM, EXCEPT WHERE APPLICABLE LAW REQUIRES OTHERWISE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to defend and indemnify Shark Shine Detail LLC and its owners, employees, and contractors against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the websites, your breach of these Terms, or your provision of false information or unauthorized access instructions.

10. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Exclusive venue for disputes arising out of these Terms or our services will be the state or federal courts located in Arizona, unless applicable law requires otherwise. You and Shark Shine consent to personal jurisdiction there.

11. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the websites or SMS program after updates means you accept the revised Terms. If you do not agree, stop using the websites and opt out of SMS.

12. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with any written job confirmation and our Privacy Policy, are the entire agreement between you and Shark Shine regarding the websites and messaging program, and supersede prior conflicting website terms on the same subject. Separate written service agreements for a specific job control if they expressly conflict.
